All services rendered are billed at an hourly rate which is itemized in detail in invoices which are submitted to the client every two weeks. Costs (i.e. filing and service of process fees) are billed separately. Normally, there are no charges for copy or mailing costs.

INITIAL RETAINER
In all but limited scope representation cases, Ed will require an initial retainer. The amount of the retainer will be will be based upon your individual circumstances and needs.
Prior to discussing the specifics of a client’s case and answering whatever questions the client may have, Ed takes this opportunity to inform the client, at length, about the applicable laws in family cases; the specific procedures which apply in all such cases; the legal requirements and bases upon which judges decide issues in these cases; the factors which are legally and practically most relevant to each individual judge hearing these cases; the manner in which judges can be requested to decide certain issues prior to trial; the statutory requirements for seeking and obtaining emergency or interim relief before any trial.
Prospective clients should bring a notepad to the initial consultation in order to take as many notes as they wish in order to understand and remember all of the information provided.

FLAT FEE PRICING
Criminal cases are billed for one fixed, flat fee – not on an hourly basis. No separate or additional charges for costs; conferences with attorney; telephone calls; or court appearances.

FLAT FEE CHARGE
Ed will require payment of a flat fee for your case. The amount of the fee will be based upon the nature of the charge or charges against you. Payment plans may be available.
Bring a note pad to the initial consult, which will usually run to 1.5 hours or more, because Ed will explain applicable statutes; meaning of elements of offense(s) charged; maximum (and, if applicable, minimum mandatory) sentences provided by law; meaning and import of discovery; speedy trial rights; nature of hearings which will be scheduled by the court; general parameters of possible plea agreements; and future conference with you wherein Ed will discuss likely content of witness testimony and exhibits to be introduced at your jury trial.

Limited Scope Representation

Under limited scope you can get anything from advice to preparation of your pleadings to preparing you for upcoming hearings to handle on your own. With limited scope the attorney will completely analyze your case for you to help you understand all of the issues you may face and will answer all of your questions. Under limited scope the attorney can also communicate with either your spouse of their attorney on your behalf.
After understanding the applicable law and procedural rules, do what you are confident you can do yourself and have Ed do what you think is outside your comfort zone. If at any point in time you want Ed to take over the entire case for you, he is available to do so upon your entering into a standard retainer agreement.

Ed Falla is a graduate of Amherst College and the University of Miami School of Law.
He practiced in the state of Florida upon graduation from law school (1979 – 1986) and has maintained his law office in Kalispell since moving to the Flathead Valley in 1987.
Ed practiced in many areas of civil and criminal law while residing in Florida, but since moving to Montana he has specialized in Family and Criminal Law.
